1. Geltungsbereich
Alle Lieferungen und Leistungen erfolgen ausschliesslich auf der Grundlage dieser AGB. Abweichende Regeln gelten nur bei vorheriger schriftlicher Bestätigung durch die Geschäftsführung der Firma Lacee.
2. Vertragsabschluß
Die Bestellung des Käufers ist das Angebot auf Abschluss des Kaufvertrages. Er kommt zustande durch den Zugang der Lieferung durch die Firma Lacee beim Käufer.
3. Preise
Preise sind angegeben in Euro und beinhalten 19% Mwst.. Sie können jederzeit, ohne vorherige Ankündigung verändert werden.
4. Versand
Alle genannten Liefertermine sind grundsätzlich unverbindlich
Beim Versand ausserhalb Deutschlands ist die Firma Lacee nicht für anfallende Zollgebühren oder Steuern verantwortlich. Diese Kosten hat der Käufer zu tragen.
Im Falle der Nichtzustellbarkeit eines Paketes erfolgt keine erneute Zustellung ohne vorherige Begleichung der anstehenden Versandkosten.
5. Eigentumsvorbehalt
Bis zum vollständigen Ausgleich des Kaufpreises bleibt die gelieferte Ware Eigentum der Firma Lacee.
6. Gewährleistung
Hat die Ware einen Mangel, ist die Firma Lacee zunächst berechtigt, auf ihre Kosten Ersatz zu liefern. Mängel müssen sofort gegenüber der Transportperson oder der Firma Lace’e, spätestens aber innerhalb von 14 Tagen ab Zugang der Ware reklamiert werden.
Ist auch die Ersatzlieferung mangelhaft, kann der Käufer nach einer Wahl innerhalb der Gewährleistungsfrist von 24 Monaten, die Rückgängigmachung des Kaufvertrages oder eine Herabsetzung des Kaufpreises verlangen.
7. Widerrufsrecht
Der Käufer ist berechtigt, seine Bestellung innerhalb von 14 Tagen gegenüber der Firma Lacee, Hafengasse 24, 89073 Ulm zu widerrufen. Die Widerrufsfrist beginnt mit Eingang der Ware beim Kunden. Der Widerruf muss keine Begründung enthalten und schriftlich, auf einem anderen dauerhaften Datenträger oder durch Rücksendung der Sache erfolgen. Zur Fristwahrung genügt die rechtzeitige Absendung. Reduzierte Ware ist vom Umtausch ausgeschlossen.
Im Falle eines Widerrufs behalten wir uns vor, angemessenen Wertersatz für die durch den bestimmungsgemäßen Gebrauch der Sache entstandene Verschlechterung geltend zu machen. Dies gilt auch dann, wenn die Ware sorgfältig behandelt wurde. Die Leistung von Wertersatz kann vermeiden werden, wenn die Ware innerhalb dieser Zeit nicht in Gebrauch genommen wird.
Bei Bestellungen bis zu einem Betrag in Höhe von 350 Euro hat der Käufer die regelmäßigen Kosten der Rücksendung zu tragen, wenn er rechtzeitig widerrufen hat, es sei denn, dass die gelieferte Ware nicht der bestellten Ware entspricht.
Im Falle einer Rücksendung wird der Kaufpreis spätestens 5 Werktage nach Eingang der Rücksendung auf das Konto des Kunden erstattet.
8. Rücktrittsrecht
Bei Schreib-, Druck- und Rechenfehlern auf der Website, in Anzeigen oder Flyern ist die Firma Lacee zum Rücktritt von hierauf beruhenden Verträgen berechtigt.
9. Konten, Kennwörter und Sicherheit
Bestimmte Eigenschaften oder Dienstleistungen, die auf oder durch die Website angeboten werden, erfordern von ihnen, ein Mitgliedskonto zu eröffnen. Sie sind für das erhalten der Vertraulichkeit ihrer Kontoinformationen, einschließlich ihres Kennwortes und für alle Tätigkeiten verantwortlich, die auf ihrem Mitgliedskonto durchgeführt werden. Sie sind damit einverstanden, der Firma Lace’e jeden nicht autorisierten Gebrauch ihres Mitgliedskontos oder Kennwortes oder irgendeine andere Verletzung der Sicherheit sofort mitzuteilen. Sie sind verantwortlich für Schäden, die der Firma Lace’e oder anderen Benutzern oder Besuchern der Firma Lace’e entstehen, welche durch unsachgemäßen oder unrechtmäßigen Gebrauch ihres Kontos herrühren. Sie dürfen zu keiner Zeit das Kennwort oder Konto einer anderen Person, ohne deren ausdrückliche Erlaubnis, verwenden. Die Firma Lace’e kann nicht und wird nicht für Verluste oder Schädigungen irgendeiner Art verantwortlich sein, die durch Nichteinhaltung dieser Verpflichtungen entstehen.
10. Rechtswahl
Für alle sich aus der Lieferung ergebenen Streitigkeiten zwischen den Parteien gilt ausschließlich das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts, auch wenn im Ausland bestellt oder in das Ausland geliefert wird .
11. Datenschutz
Die Firma Lacee weist den Käufer gemäß § 33 Abs. 1 Bundesdatenschutzgesetz sowie § 3 Abs. 3 Teledienstdatenschutzgesetz darauf hin, dass seine von ihm abgegebenen persönlichen Daten zum Zwecke der Vertragsabwicklung in maschinenlesbarer Schrift abgespeichert werden.
12. Salvatorische Klausel
Sollte eine der vorstehenden Bestimmungen nichtig sein oder werden, so bleibt die Gültigkeit der anderen Bestimmungen erhalten.

Terms and Conditions
1. Limitations
All purchases and deliveries exclusively take place on the basis of these general terms and conditions. Deviating rules apply only when previous confirmed in writing by the management of Lace’e.
2. Contract Conclusion
The order of the buyer is the offer on conclusion of the sales contract. It finalizes with the delivery of the order by Lace’e to the buyer.
3. Prices
Prices are in Euro and the VAT (19%) inclusive. Prices are subject to change at any time without notice.
4. Delivery
All dates of delivery mentioned are in principle noncommittal
Lace’e is not responsible for arising customs duties or taxes of deliveries outside of Germany. The buyer has to bear these costs.
In case of non-deliverability of a package no renewed delivery will take place without up-front payment of ensuing expenses.
5. Conditional Sale
Up to the complete payment of the purchase price the supplied goods remains property of Lace’e.
6. Warrantee
If the goods are faulty, Lace’e is first authorized to supply a replacement at its expense. A complaint must be filed immediately either with the deliverer or Lace’e, at the latest however within 14 days starting from recieving the goods. If the replacement is faulty once again the buyer can make a choice within the guarantee period of 24 months, to recieve a reduction of the purchase price or to demand the cancellation of the sales contract.
The buyer is entitled to recall his order with Lace’e, Hafengasse 24, 89073 Ulm within 2 weeks. This period begins with delivery of the goods. The recall does not have to contain a reasoning and can take place in writing, on another durable data medium or via return of the goods.
7. Right of Withdrawal
In the case of a withdrawal we reserve the right to claim appropriate financial compensation, according to the degree of degradation resulting from the use of the goods. This applies, even if the goods were treated carefully. The claiming of financial compensation by Lace’e due to usage can be avoided if goods have not been used and are in factory-new condition.
For orders up to a value of 350 Euros, the buyer has to bear the regular cost of returning the goods even if he recalled in time, unless the supplied goods do not match to the placed order. There is no return on priced reduced items.
8. Right of Cancellation
All errors in writing, printing and calculation on the website, in advertisments or flyers justify Lace’e to cancel contracts based on them.
9. Accounts, passwords and security
Certain features or services offered on or through the site may require you to open an account. You are entirely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account. You agree to notify Lace’e immediately of any unauthorized use of your account or password, or any other breach of security. However, you may be held liable for losses incurred by Lace’e or any other user of or visitor to the site due to someone else using your password or account.
You may not use anyone else’s password or account at any time without the express permission and consent of the holder of that password or account. Lace’e cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.
10. Applicable Law
The Laws of the Federal Republic of Germany under exclusion of the UN-Buyers Rights apply to all disputes between parties resulting from the sale or delivery of goods, even if the buyer does not reside in Germany.
11. Protection of Data Privacy
Lace’e notifies the buyer in accordance with § 33 para. 1 Federal Law for Data Protection as well as § 3 para. 3 Federal Law for Teleservice Protection of the fact that the personal data given is being stored in machine-readable writing for the purpose of the finalizing the contract.
12. Severability Clause
In case one of these clauses should be or become void, the validity of the other clauses remains intact.
